The Law : Constitutional Council’s Decisions Are Final

As the proficient body in charge of safeguarding the regularity of the election of Members of the National Assembly, the Electoral Code gives full powers to the Constitutional Council, stating its decisions are final. The Council rules on all petitions filled and subsequently proclaims the results of the election within the stipulated time framework as stated by law. Section 136 of the Electoral Code says “The decisions of the Constitutional Council relating to elections, election results and candidatures shall be final.” Simply put, the decisions of the Council are not subject to appeal.
Decisions of the Constitutional Council, it should be taken are taken, on all objectivity taking into consideration the law and evidence presented as basic factors. All petitions therefore relating to election operations calling on the partial or total cancelling of the voting process are ruled upon by the Constitutional Council. Usually, the complaints are heard in a public audience as warrants the principles of transparency and democracy.
