Constitutional Council : Effectively Working Since 2018

The Members of the Council were sworn-in on March 6, 2018.
Article 46 of Law No. 96-06 of 18 January 1996 to amend the Constitution of 2 June 1972 talking about the Constitutional Council states that, “The Constitutional Council shall have jurisdiction in matters pertaining to the Constitution. It shall rule on the constitutionality of laws. It shall be the organ regulating the functioning of the institutions.”
The Constitution in its Article 48 (1) further provides that, “The Constitutional Council shall ensure the regularity of presidential elections, parliamentary elections and referendum operations. It shall proclaim the results thereof.”
The Constitutional Council enshrined in the Constitution effectively became functional 22 years after the promulgation of the law. All started when President Paul Biya appointed its 11 members in a presidential decree on February 7, 2018. On March 6, 2018 the members took the oath of office before Parliament meeting in Congress chaired by the Speaker of the National Assembly, Hon. Cavaye Yeguie Djibril.
The swearing-in of members of the Constitutional Council set the institution in motion. The first test for the Constitutional Council came the same month with the election of Senators that took place on March 25, 2018. The Constitutional Council received and ruled on six pre-electoral petitions. At the end of the electoral process, the Constitutional Council officially proclaimed the election results.
