Office of Public Independent Conciliator : Who Can File A Complaint?

The General Code on Regional and Local Authorities in its Chapter three on the status and duties of the Public Independent Conciliator for the North West and South West Regions (in accordance with their Special Status as stipulated in the Constitution) provides clarifications on who can file a complaint before the independent authority. Going by the Code, the Public Independent Conciliator shall amongst other things be responsible for examining and the amicable settling of disputes between users and regional council administration, defending and protecting rights and freedoms with regards to the relationship between citizens and the region or council thereof, conducting any investigation on the functioning of regional and council public services, and preparing a report on the functioning of regional and local councils.
On that note, Section 369 (1) of the aforementioned Code states that “A complaint may be submitted to the Public Independent Conciliator by any natural or legal person who considers that his rights and freedoms have been infringed by the functioning of the regional or council administration or regional or council public institutions.” The law further stipulates that a complaint may also be submitted to the Public Independent Conciliator by any person who considers himself to be a victim of direct discrimination prohibited by law or by an international commitment duty ratified or approved b...
