New OHADA Uniform Act : English Version Submitted

A committee that was set up to review the translated version submitted the document on January 12, 2024 to the Minister Delegate at the Ministry of Justice within its eight-days timeframe.
The English version of the new OHADA Uniform Act that organises simplified recovery procedures and measures of execution has been handed to the Minister Delegate to the Minister of Justice, Jean de Dieu Momo. The document was submitted on January 12, 2024 by the committee that was set up to review the translated version, done by the OHADA Secretariat. The Uniform Act organises two simple legal procedures which a creditor may implement to compel its debtor to honour its commitment, which are; the injunction to pay and the injunction to deliver or return a property. Adopted after the last Council of Ministers of OHADA that held on October 16-17, 2023 in Kinshasa, Democratic Republic of Congo, the said Uniform Act enters into force on February 16, 2024. Already translated into English by the OHADA Secretariat, the Minister of State, Minister of Justice and Keeper of the Seals, Laurent Esso, on December 28, 2024 created a committee composed of nine members who are mainly Superscale Magistrates of English expression to review the document to ensure it is void of any discrepancies.
The committee which had as Chairperson, Justice Epuli Mathias Aloh, a Superscale Magistrate and Technical Adviser No.1 to the Minister of Justice, thus submitted its report on January 12, 2024 with its eight days timeframe, as they were commissioned on January 4, 2024. The document was handed to the Minister Delegate to the Minister of Justice, Jean de Dieu Momo who received on behalf of the Minister of State, Minister of Justice and Keeper of the Seals.
